What are your top 2 recommendations to a brand that is building up its IP enforcement program?

 

The anti-counterfeiting industry is growing and evolving at an unprecedented pace; generating and using real-time data has become essential! Unlike the online sector, which is quite mature and developed, the offline sector requires vital innovation to improve its current performance. Indeed, less than 1% of counterfeit traffic is intercepted offline and small parcels are impossible to monitor for LEAs. Therefore,

 

1. Build a data-generating strategy that will enable you to unleash the full potential of your team's efforts;

2. Share data with the industry to exponentially amplify that potential.

 

By blocking small parcels containing counterfeit goods with logistics firms, in 2023 we have shared 1000+ repeating infringers with Brands.

 

How do you show your clients the value of brand protection?

 

“The proof is the catch”. Countercheck is the only technology used by logistics firms in Europe and beyond to support LEAs in bringing the 1% of parcels containing counterfeit goods to a much higher value. Despite only three years of activity, in all the hubs where we operate, we monthly intercept at least as many parcels containing counterfeits as were intercepted in an entire year. Additionally, we constantly share with right holders the list of infringers from cases involving their brand. Speaking of impact, we are now the primary data source for enforcement activities for multiple brands.

 

What’s your favorite famous or inspirational quote?

 

The anti-counterfeiting sector, with its continuous changes and evolutions linked to the technological progress of the online market, social media platforms, global logistics supply chains, etc... forces us to keep up by constantly trying new activities, strategies and projects. Spending a year, or even part of it, without evaluating, planning or starting new approaches can create irreparable damage to the image, reputation and, therefore, to the brand's revenue. I firmly believe that maintaining a curious and action-oriented mind is essential for success.

What’s one piece of advice you can give a brand looking to enforce their IP? 

 

Consistency, perseverance, patience.  Be consistent in your pursuit of those instances that violate your IP.  Even the smallest of infractions is critical to pursue, ensuring stake with your trade dress and/or functional patents. The process can be arduous and time consuming, but the long-term viability of the company and the reputation of the brand demand this type of enforcement and follow through.

 

How can companies use customer feedback to enhance its brand protection program?

 

Your customers are your partners in business success. You want to create value with them, having that customer become a champion for your brand and enhancing organic sales and market value. By proving support of your brand and acting on their input, pursuing those counterfeit products, arguments customer value and your brand placement. You need your customers to help seed the market and find violators. Supporting their feedback entrenches your brand value and helps root out bad products that may harm brand value.

 

What’s the best piece of advice you have ever been given? 

 

“I expect you to make mistakes 20% of the time and learn from those mistakes as you grow”. If you are not making a mistake now and then, you are not taking enough risk.  Risk cultivates the opportunities for success and as you learn from those mistakes, they will then become fewer and farther in between; repeat the “good”, learn from the “bad”, and never repeat the “ugly”.
