What is one way a brand with a mature IP enforcement program can take their efforts to the next level?

 

It is hard for me to imagine a brand secure enough to feel safe in this ever changing context. Those who are professionally engaged in IP Enforcement face new challenges every day – be it online threats, IA-related risks or corruption on the new markets. The key is to anticipate those challenges and think of ways to resolve them before they become a real threat to your business. And build a team of forward thinkers (either in-house or outside) who are knowledgeable, experienced and passionate enough to help you recognize these threats as early as possible, come up with ways to take them on and help you evolve in a timely manner.

 

What are your top 2 recommendations to a brand that is building up its IP enforcement program?

 

Go to your business. These are the people who best know your product, your market, might help you see the challenges and understand where to start.

And do not underestimate the community of your peers. Professional associations, committees, meetings and networking is where you are likely to find advice, assistance, support and even an understanding shoulder to cry on over a case lost because of procedural mistakes, made during a LAE investigation.

 

Besides, why invent a bicycle when it has already been made, ridden, broken and mended before you. In most cases your colleagues have already faced the issues you are dealing with now, are ready to share their tools and help avoid mistakes.

 

What’s the best piece of advice you have ever been given?

 

Do not dwell on your failures too long. Nor on our successes for that matter. Thinking too much about your success will make you slack. Concentrating on your failures will make you afraid to do anything. Get over your failures and move on. Strike them from your life. Swallow this pill, weep a little and go ahead. Punishing yourself is not an answer. Remember, negative thoughts are destructive.

What are your top 2 recommendations to a brand that is building up its IP enforcement program? 

 

Start off with the basics and make sure everything is in place including registering trademarks, getting AFAs in place with relevant Customs, confirm budgets and set achievable objectives. My second recommendation would be to speak to other brands and industry experts about how they are operating their own Brand Protection programs and try to understand what has and hasn't worked for them that will assist you when implementing your own project.

 

How do you show your clients the value of brand protection? 

 

Provide success stories showing how in depth investigations, targeted intelligence gathering, online monitoring and working with national and international Law Enforcement can have a huge impact on you protecting your brand and that then can equate into the sales of genuine goods thus increasing profit margins. Analytical facts and figures always go a long way to show how the online space can be looked after virtually, but you can't beat actual physical videos taken during factory raid actions and then photos of seized product plus arrests of the counterfeiters to show any client just how much you are doing to protect their brand.

 

What is the most interesting place you have been to? 

 

Years ago I was fortunate enough to find myself in Peru and it was my first introduction to the history of the Incas culminating in a five day trek along the Inca trail ending up at Machu Picchu and this in itself was truly awe inspiring.

What’s one piece of advice you can give a brand looking to enforce their IP?

 

Setting aside the obvious advice of ensuring all your IP is in place timely- I feel it is very important to develop a criteria to prioritize those subject and jurisdictions posing the most risk to your brand. With the explosion of online commerce and the global reach of counterfeiters, it is very easy to spend a lot of money and have little to show for it way of supporting your business goals.

 

How do you choose a 3rd party service provider? What things do you look for?

 

I treat onboardings similar to hiring an associate- the obvious first step is to ensure they have the expertise in the areas in which I need support. For me this includes both investigations as well as legal capabilities- not every firm works in both spaces and that can mean having two providers in a particular jurisdiction. I also value if the firm has an established reputation and/or has been formally recognized for their work in the space, and if they have clients willing to serve as a reference for their work. They get bonus points for experience in my brand’s fields of fashion, accessories, and personal care.
